RENTAL AGREEMENT TERMS AND CONDITIONS
1. Definitions and Interpretation
1.1. In this Rental Agreement (“Agreement”):
“Instrument” means any musical instrument (including accessories) supplied by Orchhire under this Agreement.
“We”, “Us”, and “Our” means HireitCo, trading as Orchhire, a company registered in England and Wales (Company No. 10603316) with registered office at Unit 9, Hall Farm, Main Street, Holwell, LE14 4SZ.
“You” and “Your” means the person entering into this Agreement for the rental of an Instrument.
1.2. Words in the singular include the plural and vice versa.
1.3. References to “writing” or “written” include email correspondence unless otherwise stated.
2. Formation of Agreement
2.1. This Agreement shall take effect only when We confirm acceptance of Your rental application by email and provide an order number.
2.2. If We decline Your application, no Agreement shall arise, and You will not be charged. Reasons for refusal may include, without limitation:
Instrument out of stock;
Incorrect pricing or product information;
Delivery date not reasonably achievable;
Unsatisfactory information from credit reference checks.
2.3. We only accept applications from, and deliver Instruments to, addresses within the United Kingdom.
3. Contact and Communications
3.1. You may contact Our customer service team by telephone on 01664 786048 or by email at info@smalltoolhire.com.
3.2. We may contact You via the details provided in Your rental application (telephone, email, or post).
4. Description of Instruments
4.1. Images and descriptions of Instruments on Our website or promotional materials are for illustrative purposes only. While We endeavour to represent Instruments accurately, variations in appearance, packaging, or minor details may occur.
5. Changes Requested by You
5.1. Should You wish to amend Your order, You must notify Us promptly. We will advise of any changes to price, delivery, or other relevant factors. No amendment shall be binding until confirmed by Us in writing.
6. Duration and Termination – By You
6.1. The minimum rental period is three (3) months.
6.2. You may terminate this Agreement at any time after the minimum rental period by providing written notice to Us.
6.3. If You terminate prior to the expiry of the minimum rental period, You remain liable for the full three (3) months’ rental charge.
6.4. Subject to compliance with the minimum rental period, return carriage shall be free of charge, and no additional cancellation fees shall apply.
7. Duration and Termination – By Us
7.1. We may terminate this Agreement immediately if:
Any payment due remains unpaid seven (7) days after a reminder has been issued;
You fail to provide information necessary for Us to supply the Instrument;
You obstruct delivery of the Instrument.
7.2. If We terminate under this clause, We may deduct from any refund due reasonable compensation for costs incurred as a result of Your breach.
8. Faulty Instruments and Legal Rights
8.1. We are legally obliged to provide Instruments in conformity with this Agreement.
8.2. Nothing in this Agreement affects Your statutory rights under the Consumer Rights Act 2015, including (but not limited to):
A full refund if the Instrument is faulty within 30 days of delivery;
Repair, replacement, or refund if the Instrument is faulty within 6 months of delivery;
Remedies if the Instrument fails to last a reasonable length of time, up to 6 years.

9. Prices, Payments and Overdue Amounts
9.1. The rental price shall be as stated in:
Our price list in force at the date of order; and
Your order confirmation email.
9.2. Prices are inclusive of VAT. If VAT rates change before delivery, Your rental payments will be adjusted accordingly unless full payment has already been received.
9.3. If an error in pricing is discovered after Your order is placed, We will notify You. If the correct price is lower, You will be charged the lower price. If the correct price is higher, We may either (a) cancel the Agreement and refund You, or (b) seek Your confirmation to proceed at the correct price.
9.4. Payments must be made by Continuous Payment Authority (CPA) using a valid debit or credit card. The first rental payment and any delivery charges must be received before dispatch of the Instrument.
9.5. If any payment is not made on time, You may be liable for reasonable administrative or recovery costs.
